1. Acceptance of Terms

By purchasing, receiving, or using any product from GAOBARO LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). These Terms govern all sales and use of our products. If you do not agree to these Terms, you must refrain from purchasing, wearing, or otherwise handling our jewelry. Continued possession or use of our products constitutes acceptance of these Terms in full.

2. Eligibility to Purchase

Purchases from GAOBARO LLC may only be made by individuals who are at least 18 years of age or by legal entities authorized to enter into binding agreements. By placing an order, you represent and warrant that you meet this age requirement and that all information you provide is accurate, complete, and current. GAOBARO LLC reserves the right to refuse or cancel any order if it believes the buyer is underage, has provided false information, or intends to misuse the product.

3. Product Disclaimer

Each item sold by GAOBARO LLC is handcrafted using delicate natural grass fibers, a material chosen for its unique beauty but known for its fragility. Customers must understand that:
• These items are extremely delicate and are not suited for exposure to normal stresses associated with traditional jewelry.
• They must never come into contact with water, moisture, sweat, or excessive humidity, as this will cause permanent and irreversible damage.
• Variations in texture, color, or finish are natural results of handcrafted production and shall not be considered defects.
By purchasing, the customer expressly acknowledges that the jewelry requires special handling and assumes responsibility for maintaining the integrity of the piece.

4. Care Instructions

To preserve the condition of GAOBARO LLC jewelry, customers are required to follow all care guidelines:
• Do NOT expose jewelry to rain, showers, swimming pools, hot tubs, or hand washing.
• Do NOT store in bathrooms, kitchens, laundry rooms, or other areas prone to humidity or steam.
• Always remove jewelry prior to exercise, household cleaning, food preparation, or application of lotions, perfumes, or oils.
• Store jewelry in a clean, dry environment away from moisture and direct sunlight when not in use.
Failure to follow these instructions will immediately void all warranties and any right to returns or exchanges. GAOBARO LLC is not responsible for damage caused by improper care.

5. Limited Warranty

GAOBARO LLC warrants that its products will be free from manufacturing defects for a period of 30 days from the date of purchase. This warranty is limited and subject to the following conditions:
• Coverage applies only to defects in craftsmanship or materials.
• Damage caused by exposure to water, sweat, or moisture is explicitly excluded.
• Damage resulting from accidents, misuse, improper storage, or normal wear and tear is not covered.
• A valid proof of purchase must be provided with all claims.
This warranty is the exclusive remedy offered by GAOBARO LLC, and no other warranties, express or implied, shall apply.

6. Returns & Exchanges

All sales are considered final. Returns and exchanges are permitted only if the item arrives with a verified manufacturing defect. In such cases:
• The customer must notify GAOBARO LLC of the defect within 3 days of confirmed delivery by UPS Ground. Notifications made after this window will not be honored.
• Returned items must be unused, unworn, and in their original packaging.
• The customer is responsible for all return shipping costs.
• Any damage resulting from improper care, including exposure to water or moisture, will result in denial of the return or exchange.
GAOBARO LLC reserves the sole right to determine whether a claimed defect qualifies for return or exchange.

7. Risk of Loss & Title Transfer

All items are shipped FOB Origin via UPS Ground. Title and risk of loss pass to the customer upon confirmed delivery as recorded by UPS tracking. At that point, GAOBARO LLC is not responsible for loss, theft, or damage. Customers must pursue claims directly with UPS if loss or damage occurs after confirmed delivery.

8. Limitation of Liability

To the fullest extent permitted by law, GAOBARO LLC shall not be liable for:
• Any damage to, or destruction of, the product caused by water, moisture, or customer misuse.
• Any indirect, incidental, special, or consequential damages arising from the purchase, use, or inability to use our products.
• Any allergic reactions, personal injuries, or other harms associated with the wearing of jewelry.
The total liability of GAOBARO LLC, whether arising from contract, tort, or otherwise, shall not exceed the amount paid by the customer for the specific item in dispute.

9. Indemnification

By purchasing or using products from GAOBARO LLC, you agree to defend, indemnify, and hold harmless GAOBARO LLC, its owners, employees, agents, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from:
• Your purchase, use, or misuse of the products.
• Any breach of these Terms.
• Any violation of applicable law in connection with your use of the products.

10. Force Majeure

GAOBARO LLC shall not be held liable or deemed in default for any failure to perform its obligations under these Terms due to circumstances beyond its reasonable control. Such circumstances include, but are not limited to, natural disasters, fire, flood, storm, war, labor strikes, shipping interruptions, pandemics, supply chain disruptions, or governmental restrictions. In such cases, performance may be delayed or suspended without liability. Refunds will only be considered if fulfillment becomes permanently impossible.

11. Intellectual Property

All product designs, photographs, text, brand names, trademarks, and other materials associated with GAOBARO LLCare proprietary and protected under applicable intellectual property laws. Customers and third parties are strictly prohibited from copying, reproducing, distributing, or otherwise misusing these materials without prior written consent from GAOBARO LLC. Unauthorized use will be pursued to the fullest extent of the law.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain valid, enforceable, and binding. The invalid portion shall be replaced with a valid provision that best reflects the original intent.

13. Governing Law

These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. All disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

14. Amendments

GAOBARO LLC reserves the right to update, revise, or amend these Terms at any time. All changes will take effect immediately upon posting to our official website at www.gaobaro.com/terms. Customers are encouraged to review the Terms regularly, as continued use of our products after any update constitutes acceptance of the revised Terms.

15. Entire Agreement

These Terms constitute the entire agreement between the customer and GAOBARO LLC regarding the purchase and use of our products. They supersede any prior understandings, agreements, or representations, whether written or oral, related to the subject matter herein.

16. Arbitration of Disputes

Any dispute, controversy, or claim arising out of or relating to these Terms or the products of GAOBARO LLC shall be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in the State of Florida, and judgment on the award may be entered in any court having jurisdiction. By agreeing to these Terms, customers waive their right to bring claims in court, including the right to a jury trial, except as required by law.

17. Headings

The headings in these Terms are provided for convenience only and shall not affect the interpretation or meaning of the provisions.

18. No Waiver

The failure of GAOBARO LLC to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights. Any waiver must be in writing and signed by an authorized representative of GAOBARO LLC to be valid.

19. Assignment

Customers may not assign, transfer, or delegate their rights or obligations under these Terms without prior written consent from GAOBARO LLC. Any unauthorized assignment shall be null and void. GAOBARO LLC may assign its rights and obligations under these Terms without restriction.
